TERMS AND CONDITIONS
Welcome to Mobimed Rentals LLC (hereinafter referred to as “Mobimed Rentals,” “we,” “us,” or “our”).
Mobimed Rentals operates as a referral and coordination service that connects customers (hereinafter referred to as the “Client,” “Customer,” “Renter,” or “Borrower”) with independent third-party scooter and stroller rental providers (hereinafter referred to as the “Providers”).
By using our referral and coordination services, you agree to the following Terms and Conditions:
1. Nature of Services
Mobimed Rentals does not own, lease, warehouse, maintain, or operate any scooters or strollers.
Mobimed Rentals solely facilitates and coordinates reservations between Clients and independent third-party Providers based on the Client’s needs and preferences.
All equipment is supplied directly by the Provider.
2. Third-Party Providers
All rental equipment is owned, maintained, delivered, and operated exclusively by the Providers.
Mobimed Rentals does not control the Providers’ operations and does not guarantee the condition, safety, reliability, suitability, or availability of any equipment.
Any operational matters, maintenance standards, or performance of equipment remain the sole responsibility of the Provider.
3. Client Responsibilities
• Availability: The Customer must be present during scheduled delivery and pick-up times for residential and “Meet & Greet” orders.
• Rescheduling: If a confirmed delivery or pick-up time cannot be met, notify Mobimed Rentals at 321-405-5445 at least 24 hours in advance. Additional fees may apply.
• Equipment Inspection: Inspect equipment upon arrival and report any mechanical or cosmetic issues within one (1) hour. Failure to report within one hour constitutes acceptance of the equipment in satisfactory condition.
• Mechanical Issues: Notify Mobimed Rentals immediately of any mechanical issue. Any compensation consideration is based on the time and date of notification.
• Order Changes: All changes (delivery location, time, etc.) must be made by calling 321-405-5445. Do not contact drivers or delivery locations directly.
4. Limitation of Liability
Mobimed Rentals shall not be held liable for injuries, damages, losses, delays, cancellations, or claims arising from the use, misuse, malfunction, or operation of equipment supplied by a Provider.
Mobimed Rentals acts solely as a coordination service and assumes no responsibility for acts, omissions, negligence, or conduct of any Provider.
5. Changes to Terms
Mobimed Rentals reserves the right to modify or update these Terms and Conditions at any time without prior notice. Continued use of services constitutes acceptance of any revisions.
6. DISCLAIMER
This Equipment Rental Agreement becomes effective at the time of reservation (“Effective Date”) and is entered into by and between:
• You (the “Borrower”)
• Mobimed Rentals LLC (“Mobimed Rentals”)
• The independent rental equipment provider (“Provider”)
7. DAMAGES & LATE RETURNS
Mobimed Rentals and/or the Provider may retain the Borrower’s credit card on file to cover:
• Late return charges
• Excessive damage
• Loss of equipment
If the Borrower purchases the Equipment Protection Plan, damages covered under that plan will not be charged.
If equipment is returned on time and without damage, no additional charges will be applied.
If a security deposit is required by the Provider, the Provider must return it promptly upon proper return of equipment in accordance with the Provider’s agreement with Mobimed Rentals.
Any additional charges will be communicated prior to processing.
8. MEET & GREET (“Disney and Other Locations”)
Residential deliveries and certain hotels/resorts require meeting the Customer for delivery and pickup.
Failure to meet at the scheduled time will result in a $50 re-delivery fee.
Meet & Greet rentals left at a hotel bell desk instead of directly returned to a representative will incur a minimum $75 fee.
9. Damage Waiver Insurance
Insurance may be purchased before delivery.
Coverage includes minor equipment damage up to $200 in repair costs.
Damage exceeding $200 is not covered.
Insurance does not cover:
• Accessories (keys, chargers, baskets, cup holders, canopies, batteries, etc.)
• Loss or theft
If insurance is declined, the Customer assumes full financial responsibility for all repair or replacement costs.
All issues must be reported during the rental period.
All applicable charges will be processed to the credit card on file upon rental completion.
10. CHANGE OF EQUIPMENT (AFTER DELIVERY)
• Non-mechanical issue: $50 switch-out fee (paid before exchange)
• Mechanical issue: No charge (if no issue found, $25 inspection fee applies)
• Customer misuse (e.g., failure to charge battery): $50 fee
11. RENTAL EXTENSIONS
• Before rental start: Call 321-405-5445
• After delivery: Notify at least 24 hours before return date to avoid $50 extension fee
• Late returns: $50 per day
• Failed pickup attempt: $50 per attempt
12. PROMISE TO PAY
All rental fees are due at time of booking prior to delivery.
Any additional fees incurred during rental are due immediately.
Customer authorizes Mobimed Rentals to charge the credit card used at booking for all applicable charges.
Returned payments will incur a $40 returned payment fee as permitted by law.
Administrative or billing errors do not relieve the Customer of financial responsibility.
13. RENTAL TERM
The rental period begins on the scheduled delivery date and ends upon return of equipment to the Provider.
The Provider may repossess equipment and terminate the agreement if the Customer violates any terms.
The Customer waives claims for damages related to lawful repossession.
14. LOSS AND DAMAGE
The Renter must inspect equipment within one (1) hour of pickup.
Failure to report issues confirms acceptance.
The Renter confirms they are capable of operating equipment safely.
The Renter must return equipment in the same condition received.
The Renter agrees to pay all recovery, collection, legal, and enforcement costs.
15. WAIVER OF LIABILITY
Operating mobility equipment carries inherent risks.
The Renter assumes all risks, including injury, death, property damage, financial loss, or medical expenses arising from use, possession, or operation.
16. RELEASE
The Renter releases and discharges the Provider and Mobimed Rentals, including officers, employees, agents, shareholders, affiliates, and representatives, from all claims related to rental, possession, use, or operation of equipment.
17. INDEMNITY
The Renter agrees to defend, indemnify, and hold harmless the Provider and Mobimed Rentals from all claims, damages, losses, attorney fees, or liabilities arising directly or indirectly from the rental or use of equipment.
18. GOVERNING LAW
This Agreement is governed exclusively by the laws of the State of Florida.
All disputes shall be subject to the non-exclusive jurisdiction of the courts of the State of Florida.
19. SEVERABILITY
If any portion of this Agreement is found invalid or unenforceable, the remaining provisions shall remain in full force and effect.
20. EXCLUSION OF ANTI-SOCIAL FORCES
The Renter represents that they are not associated with organized crime, violent groups, or individuals engaged in fraudulent, coercive, or unlawful conduct, and are not acting on behalf of such parties.
21. DELIVERY
• No Refunds for Delays: No refunds will be issued for delays of up to one (1) hour caused by traffic or factors beyond Provider control.
• Hotel Delivery: Many hotels accept deliveries on your behalf. Customers must confirm with the hotel. If the hotel refuses delivery, the Customer must be present for delivery and pickup.
• Residential Delivery: A two-hour delivery window will be provided. Someone must be present. Equipment cannot be left unattended outdoors.
22. Scooter Type Availability
Three-wheel or four-wheel scooters are subject to availability.
Specific make, model, or color is not guaranteed.
The reserved class (size category) is guaranteed.
If the exact model reserved is unavailable, an equal or upgraded class will be provided at no additional cost.
